Should I measure the shoe or the insole?

The insole. It is closer to the usable internal length and is easier to compare with a pair you already own.

The label says EU 42 but the listing says UK 8. Which do I use?

Ask for the insole length in centimetres. Conversions between systems vary between makers.

Is a crease on the toe a defect?

Not automatically. Some creasing appears in storage and relaxes with wear. Report it if it is deep, paired with staining, or inconsistent between the two shoes.
